(Guangzhou Panyu Radio and Television University,Guangzhou,Guangdong 511400,China)
Abstract:The essence of ICT-TPCK is a subject-study intelligence of integrated technology. Teachers use information and communication technology to "transform" subject knowledge into knowledge that students can obtain effectively.Corresponding to the ICT-TPCK teachers' knowledge framework, teachers' ICT teaching application ability can be divided into three aspects: teaching design ability, teaching implementation ability and teaching evaluation ability. In light of the ICTTPCK, a comparative study is conducted between the ICT teaching application ability standards formulated by the United States, Japan, Canada, Australia and the Framework for Teachers' ICT Teaching Application Ability issued by UNESCO. It is found that there are some similarities in the three categories of competence: designing personalized learning, supporting students' creativity and emphasizing teachers' professional development, while there are differences in the structure and content of the system. At the same time, national standards show the value orientation that focuses on student learning and development, emphasize the continued development of teachers, and highlight the integration of knowledge and ability.

TAN Sheng-yuan
(School of literature ,Guizhou Normal University,Guiyang Guizhou 550025, China)
Abstract:Confucius founded the Confucian school and was regarded as the Confucian sect of all ages. In ancient times, he was respected as "the sage of heaven's indulgence". His ideas had a great influence on ancient society, and they still do today. In ancient times, when the average age was generally short, Confucius lived to the age of 73, which was closely related to his health-keeping philosophy. By consulting the relevant literature, we can see that Confucius had done a great deal of effort in maintaining health after he had fully affirmed and highly evaluated life. He even took health-keeping to the philosophical level. His philosophy of health preservation revolves around the idea of "benevolence", which is not only the maintenance of the subject of life, but also the choice between life and death based on benevolence, justice and morality in order to achieve the ultimate goal of health preservation.

CHEN Yong-xiang & GONG Pan
(Guangzhou University The College of Humanities, Guangzhou 510006)
Abstract:The refusal of Anglo-American diplomats to sign a peace treaty at the Paris Peace Conference had become an unprecedented move in the modern Chinese diplomatic history. But in the face of the harsh reality of secret diplomacy and power politics, the Chinese people's illusion of “right trumps might “ that the United States boasted fell into disillusion. At the Washington Conference, the "Anglo-American" diplomats, backed up by the increasingly awakened Chinese people, and using the support of American public and the favorable international situation in the Far East, demonstrated their superb diplomatic wisdom and fighting skills. Their diplomatic strategy of "alliance with the US to subdue Japan" was initially successful and finally resulted in the long-awaited recovery of the sovereignty of Shandong Province.

Nature Determining of Property Interception by an Intermediary in a Bribery Crime
WANG Chi-an
(College of Law, East China University of Political Science and Law, Shanghai 200042, China)
Abstract:In the process of bribery, the intermediary is entrusted with the transfer of property, and may intercept part or all of the property in the process of transfer. It has been quite confusing to determine the nature of this kind of interception in judicial practice, and there has been much controversy in theory. Such Interception is different from the bribery crime in terms of behavior composition and interests infringement, and should be evaluated separately. The object of the act of intercepting property should be defined in connection with the objective act. The act of intercepting bribes should be defined as the crime of embezzlement, while the act of intercepting ordinary property should be defined as the crime of fraud or embezzlement.
Key words:Bribery; Intermediary; Interception; Embezzlement
Legal Validity of Exclusion Terms and Compensation of the Commission Contract
CHEN Yu-qing
(East China University of Political science and Law,Changning Shanghai 200050)
Abstract:In case the parties to the commission contract specifically agree to exclude the arbitrary right given by Article 410 of the Contract Law to terminate the contract, the validity of such a contract term shall be recognized regardless of whether the contract is onerous or not. In the case of unpaid commission, it is due to the respect for the breakdown of the trust relationship, and the consideration of transaction efficiency is also included in the paid commission. However, consideration should be given to the fact that in an onerous contract parties are bound to restrict each other and to ensure the implementation of the contract. It can be achieved by appropriately aggravating the liability of the dismissal party, so that the legal effect of the exclusion term is reflected in the offender's heavier liability compared to no such term. In addition, in the scope of compensation, it should be clarified that any dismissal in the unpaid commission will only compensate the damage caused to the other party by "dismissal due to unfavorable period", and the scope of compensation in the onerous entrustment is not limited to direct loss or reliance interest, and the fulfillment interest shall be taken into account as well.
Key words:commission contract; exclusion term; the right of discretionary dissolution of contract; compensation for fulfillment interest
The Dilemma of the Attempted Crime of Amount and Its Solution——Take the Contract Fraud as an Example
YANG Yi-lin
(East China University of Political Science and Law, Shanghai 200042, China)
Abstract:The issue of attempted crime of amount is one of the traditional disputes in the criminal jurisprudence in our country. The dispute in theory and the rocking of the judicial interpretation position have led to the confusion in judicial practice, and efforts of scholars to try to solve this predicament have been made repeatedly for many years, but the dispute has become more and more intense, and in judicial practice no unified standard has been reached. The basic reason is that the amount is essentially the embodiment of the "quantity" of the social harmfulness. This is the disadvantage brought about by the legislative mode of "conviction + quantification" in China's criminal law. Although the amount plays a certain role, it cannot offset the fault. Therefore, the provision of amount in the criminal law of our country should be abolished gradually.
Key words:The crime of amount; The attempted crime; The establishment of crime; The contract fraud.
